Complete and accurate representation of a property is essential if a buyer is to have confidence in the purchase he or she is making. A valid purchase contract cannot exist if the condition of the property or the terms of the sale have not been honestly represented and adequately disclosed.

Real Estate Negligence and a Failure to Disclose

A real estate agent has a duty to conduct a visual inspection of the property he or she is selling and to reveal any obvious defects in the property conditions to a buyer before closing. A seller's agent must also disclose:

  • Known health or safety concerns
  • Known flaws or defects
  • Past defects such as past water damage
  • Homeowners' association dues or back taxes that a buyer will be responsible to pay
  • Potential conflicts of interest such as any financial gain that the agent may receive from a third party (escrow agent or title agent)
